CASE: Rape case was opened at the Nyanga Police Station CASE: Rape case was opened at the Nyanga Police Station
A 24-year-old man has been accused of raping his own mother.
According to court papers, the man is charged with “forcefully penetrating her vagina with his penis”.
The man, who recently arrived from the Eastern Cape, allegedly raped his mother in her Nyanga home.
But he has denied the accusation, claiming his mother had lain false charges against him after he had threatened to expose her drinking and “bad deeds” to the rest of the family.
The man, who was clean-shaven, looked frightened when he emerged from the Wynberg Magistrate's Court holding cells and stepped into the dock.
State prosecutor Nicky Konisi said the accused’s mother had opened a case of rape at the Nyanga Police Station on 6 January following the alleged attack in her home.
She added that the State would be opposing bail in the matter.
The son made his first appearance in court on 8 January and had refused Legal Aid at the time.
On Monday however, he opted for Legal Aid.
According to the accused, his mother is a liar and that he never touched her.
He said he only told her she must go to church and “change her ways”.
After a date was set for his next appearance, the man asked to speak to magistrate Goolam Bawa, who obliged.
Speaking in Xhosa, with an English court interpreter, the accused said: “I came to Cape Town on 16 December for the first time.
“I am from the Eastern Cape and came here to my mother. I saw how she lives. She drinks and does bad deeds and I spoke to her about it.
“She is supposed to go to church and take us to church, not do this. I told her. That is why she accused me of rape. I did not do this,” he told the court.
He said he knew nobody except his mother in Cape Town.
Bawa remanded him into custody until his next court appearance on 4 February.
