The mental state of alleged girlfriend killer, Wayne Lawrence, took centre stage at the Western Cape High Court on Friday.
The man accused of shooting ex-girlfriend, Angela Marinus, after allegedly stalking her also did not pitch up at court as officials from Pollsmoor Prison informed the court that he was ill.
The 36-year-old mom from Montevideo was killed outside her home in Nevada Street in December 2017.
Angela was shot in her head and neck and one of the bullets ricocheted off her and hit her 16-year-old daughter, who was with her in the car, in the foot.
It is alleged the shooter was Lawrence, and he fled the scene.
Two days later he handed himself over at Bishop Lavis SAPS.
Lawrence, who is being represented by William Booth, is accused of premeditated murder, attempted murder and breach of a protection order.
During proceedings, Booth told Judge Gayaat Salie-Hlophe that an application to have him go for observation at Valkenberg Hospital was not being opposed by the state.
Lawrence allegedly did not understand his actions at the time of the murder or afterwards.
While the state called for the court to make an order on Friday that Lawrence be transferred to Valkenberg, Salie-Hlophe said it was inhumane to make such an order as his current illness was not known.
She postponed the matter for 12 October.
