Payments made to an Elsies River mom by alleged underworld kingpin, Nafiz Modack, came under scrutiny at the Western Cape High Court yesterday as he returned to the stand.
Transactions between Modack and his co-accused Amaal Jantjies left many confused as Modack tried to explain why he paid money to her and gave her a BMW in 2019.
Jantjies, along with her former berk Janick Adonis, was catapulted into the limelight followed the grenade attack on the home of slain Anti-Gang Unit (AGU) detective Lieutenant-Colonel Charl Kinnear.
In his evidence to date, investigating officer Captain Trevor Shaw has outlined several shocking calls where Jantjies is heard trying to solicit various hitmen to carry out a shooting at Kinnear's home.
Bank records show she received R64 000 from the Empire Investments account and a BMW from Modack.
During the cross-examination yesterday, State prosecutor Advocate Greg Wolmarans contested Modack’s version that he was under the impression that Jantjies was a qualified attorney as he questioned why payments allegedly due to the law firm she worked for were instead paid into her personal account.
Modack claimed he came into contact with Jantjies through an associate known as Andre Fabing and said she could provide information about why AGU was raiding his homes.
He also claimed Jantjies asked for a whopping R30 000 to retrieve a legal firearm allegedly confiscated from one of Modack’s bodyguards. He admitted to paying her R15 000 upfront but says she never retrieved the gun and he had no idea how she planned on getting it back.
But Judge Robert Henney also questioned certain payments, saying if Modack truly believed she was an attorney he would know if the amounts paid to her were for court applications.
Modack also claimed that the law firm had allegedly hired a private investigator who "proved" that his rival Jerome "Donkie" Booysen was behind the raids conducted by AGU but strangely he was never billed for the services of the investigator.
Henney said evidence before the court showed that Amaal would not do something for free and said she had hoodwinked Modack to get money out of him.
